  1. The Company provides technology based services for booking Technomens India Pvt. Ltd. Service provider on PAN-India basis to you and you agree to obtain services offered by Technomens India Pvt. Ltd. Service Provider. Company shall have a right to start or withdraw any service without notice..
  2. The Company shall take your booking request and forward it to the Technomens India Pvt. Ltd. Service Provider. Technomens India Pvt. Ltd. Service Provider shall accept the request for service.Upon accepting the request from the Technomens India Pvt. Ltd. Service Provider, the customer care notifies you and provides the information regarding the Technomens India Pvt. Ltd. Service Provider including his/her name, contact number etc.However, Company shall have the right to cancel the booking at any time without prior notice.
  3. The Company shall made reasonable efforts to bring you in contact with the Technomens India Pvt. Ltd. Service Provider in order to obtain Service subject to availability of the Technomens India Pvt. Ltd. Service Provider in or around your location at the time of your booking request made to the Company.
  4. For the avoidance of doubt, it is clarified that the Company itself does not provide services. You further agree and acknowledge that Company is only a facilitator and is not and cannot be a party to or control in any manner any transactions between you and the Technomens India Pvt. Ltd. Service Provider. Accordingly, the contract of Service shall be a strictly bipartite contract between you and the Service Provider . Even after acceptance of booking, the Technomens India Pvt. Ltd. Service Provider may not reach at your location or decide not to render his services in which event the Company shall not be held liable to you.However, on request company may try to connect you with the alternative Technomens India Pvt. Ltd. Service Provider.
  5. You warrant that the information you provide to the Company is accurate and complete. The Company is entitled to at all-time verify the information that you have provided. You may only access the Service using the authorized means, i.e by dialling the dedicated number of the Company or/and visiting the official website or/and web application of the Company. It is your responsibility to ensure that you visit the correct portal/web application or dial-in the accurate call centre number. The Company shall not be liable if you do not visit the appropriate web portal or dial-in the correct call centre number. The Company reserves the right to discontinue or introduce any of the particular modes of booking Service.
  6. You will refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation;

Any Contract for the provision of services is between you and the Technomens India Pvt. Ltd. Service Provider and not us and we simply provide a platform to introduce Technomens India Pvt. Ltd. Service Provider to you, Technomens India Pvt. Ltd. Customer.

Your use of the service constitute your acceptance of and agreement to all of the terms and conditions in these Terms of Use and the Privacy Policy and YOUR REPRESENTATION THAT YOU SPECIFICALLY AGREE THAT BY USING THE WEBSITE, YOU ARE AT LEAST 18 YEARS OF AGE AND YOU ARE COMPETENT UNDER LAW TO ENTER INTO A LEGALLY BINDING AND ENFORCEABLE CONTRACT.

  14. Technomens India Pvt. Ltd. customer's use of the Service after such posting and/or after booking service through calling on our toll free number/web request/Application will constitute his/her acceptance of and agreement to such changes. Therefore, Technomens India Pvt. Ltd. customer should frequently review these Terms of Use and the Privacy Policy to see if there has been any update and changes incorporated.


PROCEDURE FOR AVAILING THE SERVICES OF THE COMPANY:

  1. In order to avail the Services of the Company, You shall be initially required to either log-in through the official website of the Company; or dial the dedicated number of the Company, or through Mobile application of the company on Google play store and I-tunes.
  2. Upon receiving your request for the Service, the Company may accept or reject your service request depending on the availability of the Technomens India Pvt. Ltd. Service provider.
  3. The Company shall be entitled at any time without giving any reason or prior notice to terminate or cancel Your service request.


Billing and Payment Transaction Policy

You will make payment in full to any Technomens India Pvt. Ltd. Service Provider introduced to you through us for any services provided by such Technomens India Pvt. Ltd. service provider to you (although you may choose to use internet banking to facilitate such payment). Technomens India Pvt. Ltd. customer shall make the payment through legally permitted modes which includes payment through Cash, Internet Banking, debit card, credit card etc.In the event the payment cannot be accepted through internet banking, you shall be required to pay the service charges by way of Cash.
You shall be required to pay service charges for service to the Technomens India Pvt. Ltd. Service Provider and the rates of can be found on the Website of the Company. The Service charges shall be updated or amended from time to time and it shall be your responsibility to remain informed about the current service charges for the services. Any payment made is non-refundable. After the completion of service, we will facilitate for you to receive a copy of the invoice from the Technomens India Pvt. Ltd. Service Provider.
Technomens India Pvt. Ltd. Customer offers service payments for each requested service. Two (2) days after a service is scheduled, if there is no complaint by the Technomens India Pvt. Ltd. Customer, the service will be marked as closed by Technomens India Pvt. Ltd..
At Technomens India Pvt. Ltd. 's sole discretion, refunds or credits may be granted in extenuating circumstances, as a result of specific refund guarantee promotions, or to correct any errors made by Technomens India Pvt. Ltd.. Without prejudice to the foregoing, and insofar as allowed under mandatory applicable law, Technomens India Pvt. Ltd. 's aggregate liability shall in no event exceed an amount of INR 1,000.
Technomens India Pvt. Ltd. customer will be liable for all transaction taxes on the services provided under this Agreement (other than taxes based on Technomens India Pvt. Ltd. 's income). Technomens India Pvt. Ltd. takes no responsibility for money paid to Technomens India Pvt. Ltd. Service Provider without informing Technomens India Pvt. Ltd.. Technomens India Pvt. Ltd. has no control over payments made in cash to Technomens India Pvt. Ltd. Service Provider without informing to Technomens India Pvt. Ltd. hence it is important that payments to be made to Technomens India Pvt. Ltd. Service Provider only after prior intimation to Technomens India Pvt. Ltd.. For further information regarding payment services, please contact Technomens India Pvt. Ltd. to request information about Technomens India Pvt. Ltd. 's internet banking.

Indemnification
By accepting these User Terms and using the service, you agree that you shall defend, indemnify and hold the Company, its affiliates, its licensors, and each of their officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) your violation or breach of any term of these User Terms or any applicable law or regulation, whether or not referenced herein; (b) your violation of any rights of any third party, including Technomens India Pvt. Ltd. Service Providers arranged by Us, or (c) your use or misuse of the Website.

Liability

Any complaints about the services provided by the Technomens India Pvt. Ltd. Service Provider should therefore be submitted to the Technomens India Pvt. Ltd. Service Provider. Technomens India Pvt. Ltd. customer shall, before allowing the entry of Technomens India Pvt. Ltd. service provider, check the necessary details of Technomens India Pvt. Ltd. Service Provider from id cards and match it with details provided to Technomens India Pvt. Ltd. customer by Technomens India Pvt. Ltd. /company customer care. Technomens India Pvt. Ltd. customer shall have presence of at least one male member at the scheduled time of visit of Technomens India Pvt. Ltd. Service Provider.
  7. Technomens India Pvt. Ltd. has limited control over the quality, timing or legality of Services delivered by Technomens India Pvt. Ltd. Service Provider. Technomens India Pvt. Ltd. makes only a sincere attempt to provide best service and hence does not take any responsibility of suitability, reliability, timeliness, or accuracy of the Services requested and provided by Users. Although Technomens India Pvt. Ltd. does perform background checks of Technomens India Pvt. Ltd. Service Provider, Technomens India Pvt. Ltd. cannot confirm that each Technomens India Pvt. Ltd. Service Provider is in actual, the person who they claim to be. Technomens India Pvt. Ltd. does not assume any responsibility for the accuracy or reliability of this information or any information on the Service.
  8. Neither Technomens India Pvt. Ltd. nor its affiliates or licensors is responsible for the conduct, whether online or offline, of any Technomens India Pvt. Ltd. customer or/and Technomens India Pvt. Ltd. service provider of the service.
  9. While Technomens India Pvt. Ltd. will use commercially reasonable efforts to ensure the security of all banking and other personal information, Technomens India Pvt. Ltd. expressly disclaims any liability for any damage that may result should any information be released to any third parties, and Technomens India Pvt. Ltd. customer agrees to hold Technomens India Pvt. Ltd. harmless for any damages that may result there from.
  10. Technomens India Pvt. Ltd. customer agrees not to hold Technomens India Pvt. Ltd., its affiliates, its licensors, or any of such parties, agents, employees, officers, directors, corporate partners, or participants liable for any damage, suits, claims, and/or controversies (collectively, "liabilities") that have arisen or may arise, whether known or unknown, relating to Technomens India Pvt. Ltd. customer use of or inability to use the service, including without limitation any liabilities arising in connection with the conduct, act or omission of any user (including without limitation stalking, harassment that is sexual or otherwise, acts of physical violence, and destruction of personal property), any dispute with any user, any instruction, advice, act, or service provided by Technomens India Pvt. Ltd. or its affiliates or licensors and any destruction of your information.
  11. The Company encourages you to take full responsibility of your items. In case of lost items inside your location, the Company will try to locate the items on a "best-effort" basis but the Company will not responsible for the same in case of loss or damage to the same.

You agree and acknowledge that the use of the services offered by the Company is at your sole risk and that the Company disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes. Ltd. during the three (3) months prior to the time such claim arose.
  15. The Company encourages you to bring the spare parts that will be used during the service by yourself and company does not take any responsibility for the defect in and/or non-performance of the spare part.
  16. During the course of performing the service, with or without your approval if Technomens India Pvt. Ltd. service provider takes any spare part or vital part of the equipment/appliance to outside service station for further repair or/and service, in that case Company will not be held responsible for any loss or misuse of the said spare part or vital part of the equipment/appliance.


RIGHTS AND OBLIGATION RELATING TO CONTENT
As mandated by Regulation 3(2) of the IG Rules, The Company hereby informs Users that they are not permitted to host, display, upload, modify, publish, transmit, update or share any information that:

  1. belongs to another person and to which the User does not have any right to;

You hereby agree to hold Technomens India Pvt. Ltd. harmless from any liability that may result from the use of links that may appear on the Service.

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as, but not limited to, rights of privacy and publicity) of others.
  • Use the Service for any purpose which is in violation of local, state, national, or international law.
  • Publish post, upload, distribute or disseminate any profane, defamatory, infringing, obscene or unlawful topic, name, material or information.
  • Upload files that contain software or other material that violates the intellectual property rights (or rights of privacy or publicity) of any third party.
  • Advertise or offer to sell any goods or services for any commercial purpose on the Service which are not relevant to the services offered on the Service.
  • Conduct or forward surveys, contests, pyramid schemes, or chain letters.
  • Impersonate another person or allow any other person or entity to use your identification to post or view comments.

  • Download any file posted by another User that a User knows, or reasonably should know, cannot be legally distributed through the Service.

  • Imply or state that any statements you make are endorsed by Technomens India Pvt. Ltd., without the prior written consent of Technomens India Pvt. Ltd..
  • Use a robot, spider, manual and/or automatic processes or devices to data-mine, data crawl, scrape or index Technomens India Pvt. Ltd. in any manner.
  • Hack or interfere with Technomens India Pvt. Ltd., its servers or any connected networks.
  • Adapt, alter, license, sublicense or translate Technomens India Pvt. Ltd. for your own personal or commercial use.
  • Remove or alter, visually or otherwise, any copyrights, trademarks or proprietary marks and rights owned by Technomens India Pvt. Ltd..
  • Upload content that is offensive and/or harmful, including, but not limited to, content that advocates, endorses, condones or promotes racism, bigotry, hatred or physical harm of any kind against any individual or group of individuals.
  • Upload content that provides materials or access to materials that exploit people under the age of 18 in an abusive, violent or sexual manner.


All submissions made to Public Areas will be public, and Technomens India Pvt. Ltd. will not be responsible for the action of other Users with respect to any information or materials posted in Public Areas.

Termination and Suspension of Services
Without limitation, Technomens India Pvt. Ltd. may terminate or suspend Technomens India Pvt. Ltd. customer's right to use the Service if Technomens India Pvt. Ltd. customer breaches any term of this Agreement or any policy of Technomens India Pvt. Ltd. posted on the Service from time to time, or if Technomens India Pvt. Ltd. otherwise finds that Technomens India Pvt. Ltd. customer has engaged in inappropriate and/or offensive behavior. If Technomens India Pvt. Ltd. terminates or suspends Technomens India Pvt. Ltd. customer's right to use the Service for any of these reasons, Technomens India Pvt. Ltd. customer will not be entitled to any refund of unused balance in his/her account. In addition to terminating or suspending Technomens India Pvt. Ltd. customer's account, Technomens India Pvt. Ltd. reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

Technomens India Pvt. Ltd. may terminate or suspend Technomens India Pvt. Ltd. Customer's right to use the Service at any time for any or no reason by providing Technomens India Pvt. Ltd. customer with written or email notice of such termination, and termination will be effective immediately upon delivery of such notice. Even after Technomens India Pvt. Ltd. customer's right to use the Service is terminated or suspended, this Agreement will remain enforceable against Technomens India Pvt. Ltd. customer.

Technomens India Pvt. Ltd. customer may terminate this Agreement at any time by ceasing all use of the Service. All sections which by their nature should survive the expiration or termination of this Agreement shall continue in full force and effect subsequent to and notwithstanding the expiration or termination of this Agreement.

Invalidity of one or more provisions:
The invalidity of any term of these User Terms shall not affect the validity of the other provisions of these User Terms.

If and to the extent that any provision of these User Terms is invalid, or is unacceptable in the given circumstances according to the criteria of reasonableness and fairness, a provision shall apply between the parties instead that is acceptable considering all the circumstances and which corresponds with the provisions of the void part as much as possible, taking into account the content and the purpose of these User Terms.

Confidential Information
Technomens India Pvt. Ltd. expressly disclaims any liability beyond service contract value that may arise between Technomens India Pvt. Ltd. Service Providers and Technomens India Pvt. Ltd. service receivers of its Service. Technomens India Pvt. Ltd. is only an aggregator of service providers. Though we take utmost care in collecting information and background check of service providers still we may have missed out any information unknowingly and/or Technomens India Pvt. Ltd. Service Providers have not have shared the correct and all information with Technomens India Pvt. Ltd.. Hence if any dispute arises with one or more Users, you release Technomens India Pvt. Ltd. (and our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Technomens India Pvt. Ltd. customer acknowledges that Confidential Information (as hereinafter defined) is a valuable, special and unique asset of Technomens India Pvt. Ltd. and agree that Technomens India Pvt. Ltd. customer will not disclose, transfer, use (or seek to induce others to disclose, transfer or use) any Confidential Information for any purpose other than disclosure to his/her authorized employees and agents who are bound to maintain the confidentiality of Confidential Information. Technomens India Pvt. Ltd. customer shall promptly notify Technomens India Pvt. Ltd. in writing of any circumstances which may constitute unauthorized disclosure, transfer, or use of Confidential Information. Technomens India Pvt. Ltd. customer shall use best efforts to protect Confidential Information from unauthorized disclosure, transfer or use. Technomens India Pvt. Ltd. customer shall return all originals and any copies of any and all materials containing Confidential Information to Technomens India Pvt. Ltd. upon termination of this Agreement for any reason whatsoever. The term "Confidential Information" shall mean any and all of Technomens India Pvt. Ltd. 's trade secrets, confidential and proprietary information and all other information and data of Technomens India Pvt. Ltd. that is not generally known to the public or other third parties who could derive value, economic or otherwise, from its use or disclosure. Confidential Information shall be deemed to include technical data, know-how, research, product plans, products, services, customers, markets, software, developments, inventions, processes, formulas, technology, designs, drawings, engineering, hardware configuration information, marketing, finances or other business information disclosed directly or indirectly in writing, orally or by drawings or observation.

Neither Technomens India Pvt. Ltd. nor its affiliates or licensors warrant that the service is free from viruses, worms, trojan horses, or other harmful components.

Technomens India Pvt. Ltd. and its affiliates and licensors cannot and do not guarantee that any personal information supplied by Technomens India Pvt. Ltd. customer will not be misappropriated, intercepted, deleted, destroyed or used by others.

General Provisions

1. Technomens India Pvt. Ltd. strongly discourages any direct contact with our Technomens India Pvt. Ltd. Service Provider orany call booked directly by the Technomens India Pvt. Ltd. Customer with the Technomens India Pvt. Ltd. Service Provider, as in such cases Technomens India Pvt. Ltd. has no control on whatsoever situation or condition.

2. We discourage any tips or reward to any of our Technomens India Pvt. Ltd. Service Provider however if any Technomens India Pvt. Ltd. Customer is doing so is completely based on their own will and decision.

3. Technomens India Pvt. Ltd. does not deal into any kind of material or spare parts. The Technomens India Pvt. Ltd. Customer should buy the materials required, for carrying out the Services, on their own.

4. Technomens India Pvt. Ltd. Service Provider is liable for any damage by him, in occurrence of any such event the Technomens India Pvt. Ltd. Customer is requested first contact Technomens India Pvt. Ltd. customer care and then may lodgea complaint against the Technomens India Pvt. Ltd. Service Provider, if the solution is resolved amicably.

5. Technomens India Pvt. Ltd. may decline to provide any service on National Holidays, Public Holidays, Government Holidays without any obligation to any customer or user.

6. No independent contractor, agency, partnership, joint venture, employer-employee or franchiser- franchisee relationship is intended or created by this Agreement.

7. Technomens India Pvt. Ltd. Customers are requested to report/inform us immediately for any misconduct or unsatisfied behavior of any of our Technomens India Pvt. Ltd. Service Provider so that Technomens India Pvt. Ltd. can take action for improvement. However if the misconduct is falling in the category of breach of law then Technomens India Pvt. Ltd. Customer may deal with that as per the applicable laws directly with the Technomens India Pvt. Ltd. Service Provider and Technomens India Pvt. Ltd. will not be responsible in such case.

8. Also, in case any criminal act is committed by the Technomens India Pvt. Ltd. Service Provider while providing Services, the Technomens India Pvt. Ltd. Customer, at its own will can take direct action under the laws ofcountryand also keep us informed on full details of the same. Technomens India Pvt. Ltd. will not be party to any such action. 9. All claims and disputes arising under this Terms and Conditions should be notified to the Company within 30 days from the event date after which you shall have no any claim against the Company.

Modification of the Service and User Terms:
Technomens India Pvt. Ltd. reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the Service or any content or information on the Service with or without notice. Technomens India Pvt. Ltd. will not be liable to any party for any modification or discontinuance of the Service.

Technomens India Pvt. Ltd. reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement (including the Privacy Policy at any time, effective with or without prior notice. Ltd. customer to no longer be in compliance with this Agreement, Technomens India Pvt. Ltd. customer must terminate, and immediately stop using, the Service. Technomens India Pvt. Ltd. customer's continued use of the Service following any revision to this Agreement constitutes his/her complete and irrevocable acceptance of any and all such changes. Technomens India Pvt. Ltd. may change, modify, suspend, or discontinue any aspect of the Service at any time. Technomens India Pvt. Ltd. may also impose limits oncertain features or restrict Technomens India Pvt. Ltd. customer's access to parts or all of the Service without notice or liability.

Excusable Delays (Force Majeure) :
Technomens India Pvt. Ltd. and the Technomens India Pvt. Ltd. Service Provider shall not be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by, among other things, strikes, lock-out, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences.

Dispute Resolution and Governing Law
In the event of any dispute or difference between the Parties in respect of this Agreement, the construction of any provision of this Agreement or the rights, duties or liabilities of the Parties hereto under this Agreement, the same shall be referred to arbitration by a sole arbitrator to be appointed by the Company and the arbitration shall be conducted in accordance with the provisions of Arbitration and Conciliation Act, 1996. The venue of arbitration shall be at NOIDA. The arbitration proceedings shall be conducted in English. Any award made in such arbitration will be final and binding on the parties. The arbitrator shall have the authority to order specific performance of this agreement. Subject to the foregoing, the Courts at NOIDA, Uttar Pradesh only shall have exclusive jurisdiction.

The Courts of Noida shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the services offered by the Company or the agreement or arrangement between the Service provider and the Customer. All claims and disputes arising under this Terms and Conditions should be notified to the Service Provider or Company within 30 days from the service date after which no claim shall be entertained.

In the event that Technomens India Pvt. Ltd. customer is given a code by or on behalf of Technomens India Pvt. Ltd. through which Technomens India Pvt. Ltd. customer may refer a friend to Technomens India Pvt. Ltd. in exchange for a referral credit, Technomens India Pvt. Ltd. customer shall not use any online marketing or advertising to promote such code or to artificially increase the amount of credits awarded. By way of example, Technomens India Pvt. Ltd. customer may not post, or cause, request or permit a third party to post any such code on a coupon website, nor use any paid search marketing, online advertising, forum posting, newsgroup posting or bulk email to disseminate such code. Technomens India Pvt. Ltd. customer may only share such code with his/her personal friends and acquaintances for legitimate referral purposes, as determined by Technomens India Pvt. Ltd. in its sole discretion. Without limiting Technomens India Pvt. Ltd. 's other rights and remedies, Technomens India Pvt. Ltd. may terminate such code and/or Technomens India Pvt. Ltd. customer's account for any breach of this Section.

Acceptance by our customer
I hereby acknowledge that I have read and understand the foregoing terms of use and the Technomens India Pvt. Ltd. privacy policy and agree that my use of the service is an acknowledgment of my agreement to be bound by the terms and conditions of this agreement.
